Charlie Kirk Warns GOP: ‘This Is a Constitutional Crisis’
In a recent segment of The Ingraham Angle, Turning Point USA founder Charlie Kirk sounded the alarm over a growing judicial overreach. He argued that Democrats are using nationwide injunctions to stall President Trump’s policies, effectively blocking his ability to govern. Kirk urged Senate Republicans to take action by implementing a new litmus test for judicial nominees.
The discussion followed a 5-4 Supreme Court ruling that allowed $2 billion in U.S. foreign aid to resume. Kirk strongly criticized the decision, warning that unelected judges are undermining the executive branch’s authority.
Judicial Overreach as a ‘Pocket Veto’
Kirk explained that lower court judges, often in Democrat-heavy circuits, are issuing nationwide injunctions to stall Trump’s agenda. These rulings prevent the administration from carrying out policies approved by the American people.
“They’re trying to flood the zone with so many nationwide injunctions that the Supreme Court cannot practically rule on all of these cases,” Kirk said. “If there are 100 or 200 injunctions, maybe half will ever be heard by the U.S. Supreme Court.”
According to Kirk, this tactic allows judges to run out the clock, delaying Trump’s policies indefinitely. He described it as a “constitutional crisis” that threatens the separation of powers.
A New Litmus Test for Judges
To counteract this trend, Kirk urged Senate Republicans to implement a new standard when confirming judges. He proposed a key question for nominees:
“Do you believe that a single district court judge should have the power to issue sweeping national injunctions and block the executive branch?”
Kirk cited Justice Clarence Thomas’s 2018 opinion, which argued that nationwide injunctions did not exist for the first 150 years of American governance. “The idea that a district court judge can repeatedly undermine the president’s ability to execute the laws is dangerous,” Kirk warned.
GOP’s Role in the Fight
Kirk made it clear that Republican lawmakers must take decisive action. “Congress needs to step up on spending cuts, and Senate Republicans need to stop these activist judges from hijacking Trump’s mandate,” he said.
If the GOP fails to act, Democrats will continue using the courts to block conservative policies. Kirk’s message was clear: fight back, or risk allowing unelected judges to dictate the future of the country.
